Welcome to Spice Zen. The terms “we”, “us”, and “our” refer to Zen Craft Pty Ltd (ABN 95 615 282 294) trading as Spice Zen.
We operate this website and online store, including all related information, content, features, tools, products and services (the “Services”), to provide you with a curated shopping experience. Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service (“Terms”), together with any policies referenced herein including our Privacy Policy, Shipping Policy and Return & Refund Policy, govern your use of the Services.
By accessing or using the Services, you agree to be bound by these Terms.
Nothing in these Terms limits or excludes your rights under the Australian Consumer Law (ACL).
1. Access and Account
By using the Services, you represent that you are:
- at least 18 years old; or
- using the Services with the consent and supervision of a parent or guardian.
The Services are not intended for individuals under 16 years of age.
You must provide accurate and complete information when creating an account or making a purchase. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
You must not transfer or assign your account to any other person or use a false identity.
We may suspend or terminate accounts that breach these Terms, are reasonably suspected of fraud or misuse, or where required by law.
2. Our Products
We aim to provide accurate descriptions and images of our products. However:
- natural variations may occur due to seasonal and sourcing differences
- colours may appear differently depending on device settings
- packaging, gift boxes or presentation materials may vary depending on stock availability, and substitutions of equal or greater quality may be used
- images are for illustrative purposes only.
All product descriptions, pricing and availability are subject to change without notice. We may discontinue products or limit quantities at our discretion.
Nothing in this section limits your rights under the ACL.
3. Orders
When you place an order, you are making an offer to purchase the products. We may accept or decline your order.
Once an order is accepted by us, we will issue an email advising shipment of your order from our facility.
For Pick Up orders, an order acceptance email will be issued when your order is ready for pick up from our facility.
Please review your order carefully before submitting it. We may not be able to modify or cancel an order once it has been accepted.
Where we assist by manually creating an order on your behalf (for example by phone or email), you are responsible for providing accurate product, quantity, delivery and payment information. We are not responsible for errors resulting from incorrect information supplied by you.
We may refuse or cancel orders where:
- products are unavailable
- fraudulent or suspicious activity is suspected
- resale or commercial distribution is suspected
- required to comply with law.
Purchases are subject to our Return & Refund Policy.
We begin processing orders promptly. Cancellation requests may be accepted prior to dispatch at our discretion.
Where a cancellation is approved, a refund may be issued. We may deduct reasonable administrative or transaction costs incurred in processing the order.
You represent that purchases are for personal or household use only unless agreed otherwise in writing.
4. Prices and Billing
Prices are listed in Australian dollars (AUD) and include GST unless otherwise stated.
Shipping, handling, customs duties and import charges may apply separately.
You agree to provide accurate and current billing and payment information.
By completing a purchase, you confirm that you are authorised to use the selected payment method and that all charges will be honoured.
If final courier, customs or remote delivery charges exceed the amount quoted at checkout, we may seek your approval for the additional charge or cancel the order and provide a refund.
Promotions, discounts or offers cannot be applied retrospectively.
5. Shipping and Delivery
Shipping and delivery are governed by our Shipping Policy, which forms part of these Terms.
Delivery timeframes are estimates only and may vary due to carrier delays or events outside our reasonable control.
Under the Australian Consumer Law, risk in the goods passes to you only when the goods are delivered to the address you provided.
If your order appears lost or damaged, please notify us as soon as reasonably possible so we can investigate. This request does not limit your rights under the ACL.
For international orders, you are responsible for customs duties, tariffs, taxes or import restrictions imposed by the destination country. We may refuse or cancel orders where required to comply with export controls or sanctions laws.
6. Intellectual Property
All content on this Website, including text, branding, logos, product names, spice blend names, product descriptions, design elements, graphics, layouts, recipes, photographs, videos and digital assets, is owned by or licensed to Spice Zen and is protected under Australian and international intellectual property laws.
We have made a substantial investment in the creation of our original photography, recipes, formulations and visual assets.
You must not:
- download, reproduce, copy, modify, distribute, republish or display any content
- use our images, branding or product names
- create derivative works from our content
- scrape, extract or harvest data (including for AI training or dataset creation)
- reverse engineer or analyse blends, formulations or recipes for commercial use
- use our content for commercial purposes
without prior written consent.
Purchase of a product does not transfer any intellectual property rights in our recipes, blends, product names, branding or formulations.
Recipes may be printed for personal use only and must not be reproduced, distributed or used commercially without consent.
Unauthorised use of our content may result in legal action.
All rights not expressly granted are reserved.
Shopify’s trademarks remain the property of Shopify. Third-party trademarks belong to their respective owners.
7. Optional Tools
We may provide access to tools or features operated by third parties. We do not control these tools and are not responsible for their functionality or performance.
Your use of third-party tools is at your own discretion and subject to the terms of the relevant provider.
New tools or features introduced in the future will form part of the Services and be subject to these Terms.

9. Relationship with Shopify
Our store is hosted on Shopify, which provides the ecommerce platform enabling us to offer the Services.
All purchases made through our store are transactions between you and Spice Zen.
Shopify is not responsible for the products or services we offer or for any issues arising from transactions with us.
10. Privacy
Your use of the Services is subject to our Privacy Policy.
Because our store is hosted by Shopify, Shopify also collects and processes certain personal information to operate and improve the Services.
By using the Services, you acknowledge that you have read and understood both our Privacy Policy and Shopify’s Privacy Policy.
11. Feedback
If you submit reviews, comments, suggestions or other content (“Feedback”), you grant us a perpetual, worldwide, royalty-free, transferable and sublicensable licence to use, reproduce, publish and display that Feedback for business, operational and marketing purposes, with or without attribution.
You represent that you have the right to provide the Feedback and that it does not infringe any third-party rights.
We may remove Feedback that is unlawful, misleading, defamatory or otherwise inappropriate.
12. Errors and Omissions
Information on the Services may occasionally contain typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, shipping charges or availability.
We reserve the right to correct errors or cancel orders where necessary, to the extent permitted by law.
Nothing in this section limits your rights under the ACL.

You may use the Services only for lawful purposes. You must not use the Services to:
- engage in unlawful, harmful or fraudulent activity
- violate any applicable laws or regulations
- infringe intellectual property rights
- harass, abuse or harm others
- transmit misleading, harmful or defamatory content
- upload viruses, malware or malicious code
- scrape, crawl, harvest or extract data (including for AI training or dataset creation)
- interfere with the security or operation of the Services.
We may suspend or terminate your access if you breach these Terms.
14. Termination
We may suspend or terminate your access to the Services if you breach these Terms or if required by law.
You remain responsible for any amounts due up to the date of termination.
Sections that by their nature should survive termination, including Intellectual Property, Feedback, Limitation of Liability, Indemnification, Privacy and Governing Law, will continue to apply.
15. Disclaimer of Warranties
To the extent permitted by law, the Services are provided “as is” and “as available”.
We do not guarantee that the Services will be uninterrupted, timely, secure or error free.
Nothing in this section limits or excludes any guarantees, rights or remedies under the ACL.
16. Limitation of Liability
To the extent permitted by law, we are not liable for any indirect, incidental, special or consequential loss arising from your use of the Services.
Where liability cannot be excluded under the Australian Consumer Law, our liability is limited to the remedies provided under that law.
Nothing in these Terms excludes or limits your statutory rights.

You agree to indemnify and hold harmless Spice Zen and our officers, employees, contractors and service providers from any loss arising from your breach of these Terms or your misuse of the Services.
18. Severability
If any part of these Terms is found to be invalid or unenforceable, the remainder will continue in effect to the fullest extent permitted by law.
19. Waiver and Entire Agreement
Our failure to enforce any right does not constitute a waiver.
These Terms, together with our policies, form the entire agreement between you and Spice Zen regarding your use of the Services.
20. Assignment
You may not assign your rights under these Terms without our consent.
We may assign or transfer our rights at any time.
21. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
You agree to submit to the exclusive jurisdiction of the courts of New South Wales.
22. Headings
Headings are for convenience only and do not affect interpretation of these Terms.
23. Changes to Terms of Service
We may update these Terms from time to time to reflect operational, legal or regulatory changes.
Material changes will be communicated as required by law.
Your continued use of the Services after updates are posted constitutes acceptance of the revised Terms.
24. Australian Consumer Law Guarantees
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these Terms limits your statutory rights.
25. Allergy, Safety and Usage
Our products contain natural ingredients.
You are responsible for checking ingredient lists for potential allergens before use.
We are not liable for allergic reactions resulting from known or undisclosed sensitivities where ingredients are correctly disclosed and products are used as directed.
Products must be stored correctly and handled appropriately after delivery.
26. Recipes and Preparation Guidance
Recipes, preparation suggestions and cooking instructions provided on our Website, product pages or recipe cards are for general information and home use only.
Results may vary depending on ingredient quality, substitutions, equipment, environmental conditions and individual technique. Spice Zen does not warrant or guarantee specific outcomes from following any recipe or preparation method.
You are responsible for checking ingredients for allergens, following safe food-handling practices, storing food appropriately and ensuring food is cooked thoroughly before consumption.
Nothing in our recipe content constitutes nutritional, dietary or medical advice. Nothing in this clause limits your rights under the Australian Consumer Law.
27. No Medical or Therapeutic Claims
Our products are not intended to diagnose, treat, cure or prevent any disease.
Any references to tradition, flavour or cultural use are for general information only and are not medical advice.
Please consult a qualified professional for health-related concerns.
28. Force Majeure
We are not liable for delay or failure to perform obligations due to events beyond our reasonable control, including natural disasters, pandemics, labour disputes, supply chain disruptions, carrier delays or government restrictions.
